Organic Gardening Stokes Backyard Book and CD Sweepstakes Official Rules
NO PURCHASE NECESSARY. No payment of any kind is necessary to enter or win this sweepstakes. A purchase will not improve your chances of winning. You are not a winner yet. Odds of winning: 1 out of the total number of eligible entries received. The sponsor of the sweepstakes is Rodale Inc. ("Rodale").
To enter, go to http://www.organicgardening.com/ (the "Web Site") and fully complete all requested survey information in the fields on the survey form and submit the survey as instructed. INTERNET ACCESS IS REQUIRED TO ENTER. Participants must follow all instructions to enter and win.
Sweepstakes begins 12:00 am ET December 17, 2005 and ends 11:59 pm ET January 20, 2006 (the "Promotion Period"). Entries must be received by 11:59 pm ET January 20, 2006 (ET) to be eligible to win. Only one entry per person/per email address during the Promotion Period and only entries submitted electronically to the Web Site listed above in accordance with these rules will be eligible for consideration. You may enter during the Promotion Period under one name and one e-mail address only. Any attempt by any participant to obtain more than one (1) entry by using multiple/different email addresses, identities, or any other methods will void that participant's entries and that participant will be disqualified. Enter using only an e-mail address subscribed to and registered in your name as the authorized account holder. All eligible entries received during the Promotion Period will be eligible to win after submission of such entry. Entries will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of the entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entries that are mechanically reproduced, contain inaccurate information, do not fully comply with these rules or that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the Sponsor, in whole or in part, due to computer, human or technical error of any kind are not eligible.
From all eligible entries received, Rodale will randomly select the winner on or about January 26, 2006. Winner will be notified by telephone and e-mail on or about January 31, 2006. If the winner is so notified, the winner must reply by e-mail with all contact information requested in the notification within twenty-four (24) hours from the date the notification e-mail was sent, or another winner may be selected. After the winner sends the reply e-mail, with all the requested contact information, to Rodale by the deadline for replying, Rodale will then send to the winner by postal mail at the mailing address on the winner's entry form an Affidavit of Eligibility and Release of Liability. Winner will be obligated to sign and return an Affidavit of Eligibility and Release of Liability within 14 days of postal mail notification. In the event of noncompliance within this time period, if the potential winner cannot be reached at the telephone number, email or mailing address on his or her entry form, or if a prize or prize notification is returned as unclaimed or undeliverable for whatever reason, the winner will forfeit any right to receive the prize and an alternate winner may be selected. Winner selection is under the supervision of Rodale, whose decisions are final. Entrants agree to be bound by these Official Rules and the decisions of Rodale.
Sweepstakes open only to legal residents of the 50 United States, District of Columbia and Canada (except the Province of Quebec) who are 21 years of age or older. Employees of Rodale, Sponsor and members of their immediate families & household members are not eligible. Sweepstakes subject to all federal, state and local laws and is void wherever prohibited by law. Canadian residents, to win, must first correctly answer, unaided, a time-limited mathematical skill testing question administered by mail.
Any prize or prize notification returned to Rodale as undeliverable may result in the awarding of that prize to an alternate winner in a separate random drawing. By acceptance of a prize, winner consents to the use of his/her name, photograph or other likenesses, testimonial and other biographical information for any and all purposes, including, but not limited to, advertising, trade and/or promotion on behalf of Rodale, without further compensation, unless prohibited by law. By entering the sweepstakes, entrants will be sharing their personal information with Rodale. Personal information collected by Rodale will be used for administration of the sweepstakes. In addition, by entering, entrants agree to Rodale's use of entrants' personal information as described in Rodale's privacy policy at http://www.rodale.com/corp/sub/1.1874.1-28.00.html. Please refer to Rodale's privacy policy for important information regarding the collection, use and disclosure of personal information by Rodale. Rodale is not responsible for disclosures made by any other third party. Rodale uses reasonable commercial efforts to comply with Federal CAN-SPAM Guidelines and entrants may subsequently opt-out of receiving further e-mails by following opt-out instructions contained in the e-mail or Rodale's privacy policy. All entries become property of Rodale and will not be acknowledged or returned.
Consumer Disclosure The approximate retail value of the prize is $29.95 and consists of one (1) Stokes Backyard Bird Book and CD. The prize will be awarded to one winner. All other expenses not specifically listed herein are the winner's responsibility including, but not limited to, sales taxes. All federal, state and local taxes are the sole responsibility of the winner. No transfer or substitution of prize except at Rodale's sole discretion. Prize values are in U.S. currency. Substitution of a prize of equal or greater value (or a cash equivalent) will be awarded in case of prize unavailability. All prizes will be awarded within 1 year of receipt of valid and executed winners' affidavit or prize confirmation. However, any portion of the prize not accepted by the winner will be forfeited.
Rodale and its parent, subsidiary or affiliate companies, shall not have any obligation or responsibility with regard to (i) entries that contain inaccurate information or do not comply with these rules, (ii) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind, (iii) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties, (iv) any inability of the winner to accept the prize for any reason; (v) if a prize cannot be awarded due to travel cancellation, delays or interruptions due to Acts of God, natural disasters, terrorism or weather; or (vi) any damages or losses of any kind caused by any prize or resulting from awarding, acceptance, possession use, misuse, loss or misdirection of any prize or resulting from participating in this promotion or any promotion or prize related activities. Rodale, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of this promotion or otherwise violating these rules. If Rodale determines, in its solediscretion, that technical difficulties or unforeseen events outside its control compromise the integrity or viability of the promotion, Rodale reserves the right to void the entries at issue, modify the promotion and/or terminate the relevant portion of the promotion.
A winner's list will be posted on the Website on or around January 31st, 2006.
